Terms of Service

These Terms explain the rules for using MemriTree, including accounts, story creation, AI-generated content, sharing, subscriptions, story credits, and gifts.

Agreement to These Terms

These Terms of Service are an agreement between you and MemriTree LLC. By accessing or using MemriTree, creating an account, purchasing story credits, subscribing to a plan, buying a gift, or sharing a story, you agree to these Terms.

If you do not agree to these Terms, do not use MemriTree. Our Privacy Policy explains how we collect and use information.

Who May Use MemriTree

You must be at least 18 years old to create an account or use MemriTree. If you use MemriTree on behalf of someone else or submit family materials involving other people, you are responsible for having the right and permission to do so.

Accounts and Security

You are responsible for the information you provide, for keeping your sign-in credentials secure, and for activity that occurs through your account. You may sign in using email and password or supported third-party sign-in options such as Google Login.

Tell us promptly if you believe your account has been accessed without permission. We may suspend or restrict account access if we believe it is necessary to protect you, other users, MemriTree, or the service.

What MemriTree Provides

MemriTree helps users turn memories, written prompts, recorded audio, transcripts, photos, and other story materials into illustrated keepsake stories. The service includes story creation, editing, image generation, audio and photo handling, story credits, sharing tools, gifts, subscriptions, and account and billing management.

We may add, change, pause, or remove features over time. We may also limit or suspend features for maintenance, security, cost control, abuse prevention, or operational reasons.

Your Content

“Your Content” means the materials you submit to MemriTree, including prompts, memories, text, recordings, transcripts, photos, names, gift messages, edits, and story instructions. You are responsible for Your Content and for making sure you have the rights needed to submit it.

You keep ownership of Your Content. You give MemriTree permission to host, store, process, copy, display, modify, format, generate from, and otherwise use Your Content as needed to provide, support, secure, and improve the service.

Do not submit content that violates another person's rights, privacy, publicity rights, intellectual property rights, or applicable law.

Generated Stories and AI Output

MemriTree uses AI services to help create story drafts, transcripts, summaries, image prompts, and generated images. AI output can be incomplete, inaccurate, similar to other generated content, or different from what you expected. You are responsible for reviewing and editing generated stories before relying on or sharing them.

As between you and MemriTree, you may use the story text and images generated for your account for personal, family, and non-commercial sharing, subject to these Terms and any rights of others whose names, likenesses, stories, photos, or voices appear in the content.

Story Sharing and Visibility

Stories are private unless you choose to share them or make them visible through a public share link. You control story visibility and audio visibility settings in the product.

If you share a story link, people who receive it may view, copy, screenshot, download, forward, or otherwise disclose what they can access. You are responsible for deciding whether a story is appropriate to share.

Acceptable Use

You agree not to misuse MemriTree. For example, you may not:

  • use MemriTree for illegal, deceptive, harmful, abusive, harassing, or exploitative purposes;
  • submit content that you do not have the right to submit;
  • upload malware or attempt to interfere with the service;
  • try to bypass security, authentication, payment, credit, rate limit, or access controls;
  • scrape, copy, or reverse engineer the service except where allowed by law;
  • use MemriTree to impersonate someone or misrepresent your relationship to a person or story; or
  • use generated content in a way that violates another person's rights or applicable law.

Subscriptions, Story Credits, and Purchases

MemriTree offers subscription plans and one-time story credit purchases. Prices, plan names, included credits, renewal timing, and checkout details are shown in the product and at checkout.

Subscription credits refresh each billing period and may expire at the end of that billing period. Purchased and gifted Story Pack credits do not expire unless we clearly state otherwise or an account is closed, suspended, or terminated under these Terms.

Story credits are not cash, stored value, gift cards, or currency. They cannot be transferred, resold, redeemed for money, or used outside MemriTree unless we expressly allow it.

Billing, Renewals, Cancellations, and Refunds

Payments are processed by Stripe. By starting checkout, subscribing, changing a subscription, buying a Story Pack, or purchasing a gift, you authorize the applicable charges shown at checkout.

Subscription plans renew automatically until canceled. You can manage or cancel subscriptions through the MemriTree account area and Stripe customer portal. Cancellations generally take effect at the end of the current paid billing period unless the checkout or portal flow states otherwise.

Subscription upgrades, downgrades, and cancellations may result in prorated charges, scheduled plan changes, changed credit allowances, or continued access through the paid period, depending on the Stripe checkout or portal flow and the plan change selected.

Except where required by law or expressly stated in the product, payments are non-refundable. If something goes wrong with a purchase, gift, subscription, or credit grant, contact us through the support page and we will review the issue.

Gifts

MemriTree lets users purchase Story Pack gifts for recipients. Gift buyers are responsible for entering the correct recipient name and email address. Gift credits can only be claimed by signing in with the recipient email address associated with the gift.

A gift is not complete until payment is confirmed. If an email delivery problem occurs, the gift may still be associated with the recipient email and may be claimable once payment is confirmed.

Third-Party Services

MemriTree relies on third-party services for authentication, hosting, database and file storage, payments, email delivery, analytics, and AI processing. Those providers may have their own terms, privacy policies, and service rules. We are not responsible for third-party services outside our control.

MemriTree Intellectual Property

MemriTree, including our name, logo, design, software, templates, workflows, prompts, interfaces, and other service materials, is owned by MemriTree or our licensors. These Terms do not give you ownership of MemriTree or the right to use our branding except as needed to use the service.

If you send feedback or suggestions, you allow us to use them without restriction or compensation.

Service Availability and Changes

We aim to keep MemriTree available and useful, but we do not promise that the service will always be available, uninterrupted, secure, error-free, or compatible with every browser, device, file, or story material. Some features may fail or take longer because of third-party provider outages, network issues, file quality, content constraints, or AI processing limits.

Disclaimers

MemriTree is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

MemriTree is not a backup service, legal service, archival guarantee, genealogy verification service, medical service, or professional advice service. Keep your own copies of important recordings, photos, documents, and story materials.

Limitation of Liability

To the fullest extent allowed by law, MemriTree will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, lost goodwill, service interruption, or unauthorized access.

To the fullest extent allowed by law, MemriTree's total liability for any claim related to the service will be limited to the greater of the amount you paid MemriTree in the three months before the claim or $100.

Indemnity

You agree to defend and hold harmless MemriTree from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from Your Content, your use of MemriTree, your violation of these Terms, or your violation of another person's rights or applicable law.

Suspension and Termination

You may stop using MemriTree at any time. We may suspend or terminate access if we believe you have violated these Terms, created risk for MemriTree or others, failed to pay amounts owed, misused credits or gifts, or used the service in a harmful or unlawful way.

Termination may affect access to stories, credits, subscriptions, account data, and shared links. Some provisions of these Terms will continue after termination, including provisions about ownership, payment obligations, disclaimers, limitations of liability, indemnity, and dispute-related terms.

Changes to These Terms

We may update these Terms as MemriTree changes. When we do, we will update the “Last updated” date. If changes are material, we may provide additional notice in the product or by email. Your continued use of MemriTree after updated Terms take effect means you accept the updated Terms.

Governing Law and Disputes

These Terms and any disputes related to MemriTree are governed by the laws of the United States and applicable state law, without regard to conflict of law rules. If a dispute arises, please contact us first so we can try to resolve it informally.
